SECOND MORTGAGES

If you have a second mortgage, line of credit, HELOC, or past due Homeowner’s association dues, you may be able to have them wiped out or discharged as unsecured debt through a Chapter 13 Bankruptcy.

This is appropriate only if the value of your home is less than the balance on your first mortgage.

If we are able to prove to the court that the value of your home is less than the balance on your first mortgage, we may be able to obtain an Order that states that your second mortgage, line of credit, HELOC, or past due homeowner’s association dues will be discharged as unsecured debt once all of the Chapter 13 Plan payments are completed.
